Does anyone know the penalty for overstaying a visa in Germany. I know that you can stay for 90 days on a tourist visa, but i will be leaving germany for the US a week after it will expire. Will have have problems getting back to the US. And if there is a fee how much?

Hmm… well you shouldn’t need anything more than a regular passport to stay in germany for 90 days. Now, if it is your PASSPORT that’s going to expire, they might not even let you into the country; alot of places won’t let you into the country if your passport is going to expire within the next six months.

But I mean, if you had a passport, I don’t know why you’d need a Visa in the first place… so maybe someone else can help you?

I think she’s asking, what happens if she overstays the 90 days she’s allowed to stay in Germany?

Is there any penalty?

Sarah—Maybe you should contact the German embassy nearest to you and ask them?

I really have no idea.

Yeah, if that’s the case, contacting the embassy is the best thing. I’m sure a week over the limit won’t get you 30 yrs in jail or anything , and most likely noone would notice. BUT, if they did, who knows. I’m sure if you talked to the right person, or enough of them (hehe), you could get some sort of ‘extension’ on your stay. Really the main reason there is a limit is because they don’t want people coming into the country and staying indefinitely, working illegally, not paying taxes, etc etc.

The worst that can happen to you if a) you are caught and b) anyone cares is that you will be excluded from re-entering Germany for ?? years. The probability of this happening is close to zero for a few days. Just have a story ready to tell that involves your dog having a heart attack….
